Governing Laws and Jurisdiction
This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of South Africa.
Any dispute, controversy or claim arising out of or in connection with this Agreement, or the breach, termination or invalidity thereof, shall be settled through the following process:
- Amicable Resolution: The parties shall attempt to resolve the dispute amicably through mutual consultation and negotiation.
- Mediation: If the dispute is not resolved within 30 days, either party may refer the dispute to mediation in accordance with the rules of the Arbitration Foundation of South Africa (AFSA).
- Arbitration: If mediation is unsuccessful, the dispute shall be referred to arbitration in accordance with the AFSA rules, and the award shall be final and binding on both parties.
The parties hereby submit to the exclusive jurisdiction of the courts of South Africa for the purpose of enforcing any award or judgment.
